Terms of Use Agreement

This Terms of Agreement (“Agreement”) constitutes a legally binding contract between you (“Client,” “you,” “your”) and Translatedpage.com (“Company,” “we,” “us,” “our”) governing your access to and use of our website, services, and content.

By accessing our website, submitting an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained herein. If you do not agree with any part of this Agreement, you must immediately cease all use of our website and services.

1. Description of Services

The Company provides professional translation, notarization, apostille, and related document services (“Services”). The scope of these Services will be defined by the specific order placed by the Client and confirmed by the Company.

The Client is responsible for providing clear, legible, and complete source documents. The Company is not responsible for any translation inaccuracies or omissions resulting from unclear, illegible, or incomplete source materials provided by the Client.

2. Payments, Refunds, and Chargebacks

a. Payment: Full payment is required before any Service can be initiated. We accept major credit/debit cards and other electronic payment methods as specified on our payment page. By submitting payment, you authorize the charge to your selected payment method.

b. All Sales Are Final: Due to the custom, service-based nature of our work, all sales are final and non-refundable once a project has commenced. We do not offer refunds for completed work. If you believe there is a material error in our work, you must notify us in writing within five (5) business days of delivery to be considered for a correction at our sole discretion.

c. Policy on Chargebacks: Initiating a credit card chargeback for services rendered is a breach of this Agreement. We view chargebacks as a form of “friendly fraud.”

• You agree that you will not, under any circumstances, issue a chargeback with your credit card company.
• In the event a chargeback is initiated, we will pursue all available legal and civil remedies to recover the full payment. This includes, but is not limited to, reporting the incident to all major credit reporting bureaus and referring the outstanding debt to a collections agency.
• You will be held responsible for the original service fee, plus any additional fees incurred by the Company as a result of the chargeback, including bank penalties, collection agency fees, and all reasonable attorneys’ fees required to resolve the matter.

3. Limitation of Liability and Disclaimer of Warranties

a. Errors and Omissions: While we employ professional, vetted translators and a rigorous quality assurance process, the Company does not guarantee that any translation will be 100% error-free. The Client is solely responsible for reviewing the final translated document for accuracy and correctness, especially concerning proper nouns, names, dates, and technical terminology. Our liability for any error or omission is strictly limited to correcting the error at no charge or, at our sole discretion, providing a partial credit up to the total amount paid for the Service.

b. No Consequential Damages: Under no circumstances shall the Company, its affiliates, or its employees be liable for any direct, indirect, incidental, special, or consequential damages. This includes, but is not limited to, damages resulting from a rejected application (USCIS, RMV, etc.), a lost business opportunity, legal complications, or any other financial or personal loss arising from the use of, or inability to use, our Services, even if we have been advised of the possibility of such damages.

c. Maximum Liability: The entire liability of the Company for any claim, loss, or damage arising out of or in connection with any Service provided shall not exceed the total amount paid by the Client for that specific Service.

4. Client’s Responsibility to Review

Upon delivery, the Client has a responsibility to conduct a final review of all translated documents. Any requests for corrections of objective errors must be submitted in writing within five (5) business days. Failure to do so will constitute a final acceptance of the document as-is.

5. Indemnification

You agree to indemnify, defend, and hold harmless Translatedpage.com and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of our website and Services, or your violation of this Agreement.

6. Governing Law and Dispute Resolution

a. Governing Law: This Agreement and any dispute arising from it shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

b. Exclusive Jurisdiction and Venue: You irrevocably agree that any claim or dispute you may have against the Company must be resolved exclusively by a state or federal court located in Middlesex County, Massachusetts. You agree to submit to the personal jurisdiction of the courts located within Middlesex County, Massachusetts, for the purpose of litigating all such claims or disputes.

c. Attorneys’ Fees: In the event of any litigation arising from a breach of this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and court costs from the non-prevailing party.

7. Prohibited Use and Competitor Policy

Our website and Services are for the sole use of our clients. Competitors are strictly prohibited from using our website, services, or content for any purpose, including but not limited to price comparison, service analysis, or any form of data gathering. Any such unauthorized use constitutes a violation of this Agreement and may result in legal action.

8. Entire Agreement

This Agreement constitutes the entire agreement between you and Translatedpage.com and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written. We reserve the right to modify this Agreement at any time. Your continued use of the site after such modifications will constitute your acknowledgment and acceptance of the modified terms.
